A woman was convicted of harassment after accessing her former supervisor's email, leaving messages, and making phone calls. The woman had had a two year affair with the supervisor in Northern Virginia before moving to Chattanooga. The woman used "Spoofcard" to hide the phone numbers she was calling from and used "yourhackerz.com" to access his voicemail. The
Fourth Circuit remanded the case for sentencing stating that the two felonies should have been misdemeanors. Several organizations filed briefs with the Court arguing that the mere access of another's email account should not rise to the level of a felony. The decision could have a substantial impact on the criminalization of spouses accessing each other's email to gain evidence in
divorce or
child custody disputes.
