A: In most cases, under Virginia law, there is a statutory waiting period during which couples must remain separate and apart from one another prior to commencing a divorce action. Couples may have to wait up to 12 months from the date of separation before filing suit for divorce. If no children are born of the marriage, and couples are able to reach a property settlement agreement, then the statutory waiting time is reduced to 6 months.
